Welcome to Surge Designs (“we”, “us”, “our”). By commissioning a project, accessing materials, or using any website we create, you agree to these terms. They exist to protect both sides — clear, fair, and in plain English.

1. Services

We design, build, and support websites, landing pages, and digital assets. Scope, deliverables, and timelines are agreed in writing before work begins. We use modern, secure technologies and proven frameworks such as Tailwind CSS and Laravel to ensure performance and maintainability.

2. Payments

  • A deposit is required to secure a booking. Remaining balance is due at launch or the date agreed.
  • Invoices are in GBP and exclude VAT unless stated. Work and access may pause if invoices are overdue.
  • Third-party costs (e.g. domains, hosting, fonts, stock assets) are charged at cost unless otherwise agreed.

3. Security & Client Responsibility

We take reasonable and industry-standard steps to build securely and prevent data breaches or cyberattacks. That includes up-to-date software, secure hosting recommendations, and basic hardening at handover.

However, no system is perfectly secure. You acknowledge that the ongoing security, monitoring, and backup of your website are your responsibility unless you are on a managed care plan. We strongly recommend an independent security scan from a verified third party after launch — particularly for sites handling personal data, payments, or login systems.

Surge Designs cannot be held liable for loss, downtime, or breach resulting from misuse, poor password management, outdated plugins, or lack of post-launch maintenance.

4. Ownership & Rights

  • You own the final website content, copy, and images you’ve provided or paid for.
  • We retain ownership of our underlying code, frameworks, and design systems (“developer materials”), but grant you a perpetual license to use them on your website.
  • Third-party licenses (fonts, plugins, or themes) remain subject to their original provider terms.

5. Limitation of Liability

We’ll take reasonable care and skill in delivering your project. But things break, the web changes, and third-party software can fail. Our total liability is limited to the total amount you paid for the specific project giving rise to the claim.

We aren’t liable for indirect, consequential, or financial losses including — but not limited to — lost profits, lost data, or downtime caused by hosting, third-party services, or unauthorised access.

6. Warranties

We warrant that your site will perform substantially as described at handover. We can’t guarantee specific search rankings, sales, or conversions. Browser and device compatibility is provided for the current major releases at launch.

7. Pause & Termination

  • You may cancel a project anytime. Work completed and third-party costs remain payable.
  • We may pause or terminate for non-payment, misuse, or legal risk.

8. Portfolio Use

We may display non-confidential screenshots or case studies of your project in our portfolio or marketing. You can request in writing for any project to remain private or under NDA.

9. Legal Stuff

  • These terms are governed by the laws of England and Wales. Any disputes will be handled in the courts of England and Wales.
  • If any part of these terms is found unenforceable, the rest still stands. Updates take effect when posted here.
